2. About Exectables and NOMARK

Exectables is a brand operated by NOMARK Pty Ltd (ABN 72 687 436 219), an Australian company. Exectables is a private bench of retired senior Australian investment-operations professionals, engaged by firms and senior managers for retained mentorship and project advisory. In these terms, "we", "us", and "our" mean NOMARK Pty Ltd.

3. Services

We provide a platform that introduces firms and senior managers to retired senior executives for retained mentorship and project advisory. The scope, deliverables, cadence, and fees of each engagement are agreed between the parties and may be recorded in a separate engagement agreement.

Our website provides information about the bench, exec profiles, and the means to request an introduction. We may also offer digital tools and resources through the platform.

4. User responsibilities

When using our website and services, you agree to:

7. Australian Consumer Law

Our services come with guarantees that cannot be excluded under Australian Consumer Law. For major failures, you are entitled to cancel your service contract and obtain a refund, or to choose a refund or a replacement service. Compensation for reasonably foreseeable loss or damage is also available. For non-major failures, you are entitled to have the problem remedied within a reasonable time.

8. Limitation of liability

To the extent permitted by law, the liability of NOMARK is limited to re-supplying the services, paying for the re-supply of the services, or the cost of having the services supplied again. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under Australian Consumer Law that cannot be lawfully excluded.

9. Privacy and data protection

Your privacy is important to us. The collection, use, and disclosure of personal information is governed by our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
